CityDent.hu Limited Liability Company (registered office: 1051 Budapest, Bajcsy-Zsilinszky út 12., company registration number: 01-09-343802; tax number: 23010471-1-41.), as a healthcare service provider (hereinafter: Healthcare Service Provider) and the Client (hereinafter: Client) as Parties (hereinafter: Parties) have concluded a contract for the provision of dental healthcare services (hereinafter: Contract) and in the absence of any other written agreement to the contrary, these General Terms and Conditions (hereinafter: GTC) shall apply. By signing the Contract, the Client acknowledges that they have become acquainted with the GTC, read them, understood them, and accepted them as binding upon themselves.
Through the use of healthcare services, the Parties establish a commissioning relationship with each other for the provision of dental services to be provided against payment of a commission fee.
The Healthcare Service Provider offers dental services to the Client in accordance with applicable laws, professional protocols, and the conditions set out in this GTC.
The Healthcare Service Provider declares that it has the necessary material and human resources, general professional liability insurance, and the appropriate regulatory permits for the provision of healthcare services.
The location for the provision of dental services is 12 Bajcsy-Zsilinszky Road, Budapest 1051. The clinic is open from Monday to Friday from 9:00 am to 6:00 pm. The clinic is closed on weekends and public holidays. Emergency services are not available outside of regular business hours.
During the use of the service, the Parties are obliged to cooperate. As part of fulfilling this obligation to cooperate, the Customer informs the Healthcare Provider or treating physician of all circumstances and facts (including in particular all previous illnesses, possible pregnancy, treatment, medication or medicinal product use, health-damaging risk factors) that are necessary for the preparation of an appropriate treatment plan and the provision of the service. The Customer’s obligation to provide information also covers all facts and circumstances related to their own illness (including in particular infectious diseases, illnesses that exclude job performance, and conditions) that may endanger their own or others’ lives or physical integrity. If the Customer fails to fulfill the above information obligation, or only partially fulfills it, the Healthcare Provider shall not be held liable for any professional or financial consequences resulting from such failure.
Healthcare Provider, in compliance with applicable laws, professional protocols, and the terms of this GTC, provides dental services to the Customer with qualified dentists, dental assistants, and subcontractors, and ensures the necessary dental technology and other equipment and materials.
The Parties agree that in order to provide dental services, the Healthcare Provider may also use subcontractors, and will be responsible for the services provided by its subcontractors as if it had performed the services itself.
The use of dental services requires prior registration, which the Customer can do online by clicking on the “Book Appointment” menu on the www.citydent.hu website.
The Client is obliged to appear in a suitable physical and mental condition for the use of healthcare services, otherwise the Healthcare Service Provider is entitled to refuse to provide the service. The Healthcare Service Provider performs its dental activities on the www.citydent.hu website based on the service specified by the Client during the booking. The Healthcare Service Provider is entitled to deviate from the service specified in the booking independently, however, it is always obliged to consult with the Client in advance.
The private healthcare services provided by the Healthcare Provider are not covered by social security financing (OEP), and the services can be obtained by the Client upon payment of a fee. The current price list of the Healthcare Provider is available at citydent.hu/araink.
The Client acknowledges and agrees that if their treating physician recommends additional services beyond the pre-agreed ones and the Client decides to use them, they are obliged to pay for the additional services as well. The Client can request information about the fees for the recommended additional services from their treating physician or the customer service of the Healthcare Provider prior to their performance.
The Healthcare Service Provider is entitled to unilaterally modify its list prices at any time, simultaneously with their publication.
The Client acknowledges that failure to pay the fees may result in criminal charges.
The Client can pay for the dental service by:
cash, or credit card.
The Client may cancel the reserved service free of charge at least 24 hours before the start of the service. In the event that the Client cancels the treatment within 24 hours or does not show up for the treatment without prior notice, the Healthcare Service Provider shall charge the Client a cancellation fee of HUF 10,000 for each of the aforementioned cases.
The Healthcare Provider shall only be liable for damage according to the liability insurance applicable to its activities, which is intentionally or caused by gross negligence of the Healthcare Provider and its personnel, and which are directly and exclusively related to the provision of dental screening services or the behavior of the Healthcare Provider and its personnel.
In addition to the well-known risks of the service, special conditions causing complaints can also arise as a result of the service requested by the Client, for which the Healthcare Provider is not responsible.
The Healthcare Provider shall not be liable for any complications or other illnesses arising from the breach of the obligations set out in these GTC or the separate information and agreement by the Client, or the failure to follow the instructions, recommendations, or advice given by the physician or other person acting on behalf of the Healthcare Provider.
The present Terms and Conditions apply to the dental services provided by the Healthcare Provider, as specified in point 2 of its regulations.
These Terms and Conditions have general applicability to all matters unless specifically provided otherwise in a separate agreement between the Healthcare Provider and the Client.
The Healthcare Provider is entitled to modify these Terms and Conditions at any time, and such modifications will be announced on its website (citydent.hu).
The Parties shall settle their disputes through peaceful means. If negotiations regarding this matter do not lead to a result, the Parties shall submit themselves to the exclusive jurisdiction of the court that is competent and has jurisdiction in accordance with the seat of the Healthcare Service Provider.
In matters that are not regulated by this current GTC and the individual contract, Hungarian law shall apply, especially the Act CLIV of 1997 on healthcare, the Act LXXXIV of 2003 on certain questions regarding the exercise of healthcare activities, the Act XLVII of 1997 on the handling and protection of personal data related to healthcare, the Government Decree 96/2003 (VII. 15.) on the general conditions for the practice of healthcare services and the licensing procedure, the Ministerial Decree 60/2003 (X.20.) ESZCSM on the minimum professional requirements for the provision of healthcare services, the Civil Code, as well as other healthcare, social security laws, professional guidelines, and the professional protocol rules of the Healthcare Service Provider.
This current GTC shall enter into force on January 21, 2021, and shall remain in effect until further notice.
